Welcome to the website of Moon House Massage LLC (Moon House Massage) (the “Website”). Moon House Massage is a provider of massage therapy and skin care services. Moon House Massage & Aesthetics appreciates your patronage, and encourages you to carefully review the terms and conditions policies (“Terms and Conditions” or the “Agreement”) set forth below.
These Terms and Conditions apply to your experience on the Website either utilizing content set forth or booking appointments for services. It contains very important information about your rights and obligations as well as limitations and exclusions that apply to you.

By scheduling an appointment for services with Moon House Massage, you acknowledge that you have read, accepted, and agreed to be bound by these Terms and Conditions (in its present state with changes or amendments) and to comply with all applicable federal, state, and local laws, in relation to your access to or use of this Website. These Terms and Conditions are subject to modification without prior written notice at any time in Moon House Massage’s sole discretion. You should periodically review these Terms and Conditions for any changes.

In consideration of use of this website and booking massages and/or skin care services from Moon House Massage, Client agrees to all of the following terms and conditions:

A. INFORMED CONSENT

Client understands that Massage is intended to enhance relaxation, reduce pain caused by muscle tension, increase range of motion, and improve circulation. Client understand the general benefits of massage. Client understand that Client is responsible to inform Client’s therapist of all injuries or surgeries prior to the start of Client’s massage. Your massage therapist will go over any contradictions and treatment plans with Client in person.

Client understand that Massage therapy is not a substitute for medical treatment or medications, and that is recommended that Client concurrently work with Client’s primary caregiver for any condition Client may have. Client is aware that massage therapy does not diagnose illness or disease, does not prescribe medications, and that spinal manipulations are not part of massage therapy. Client will inform Client’s therapist of all of Client’s known physical conditions, medical conditions, medications, and Client will keep Client’s current therapist updated on any changes.

B. RATES AND SERVICES

Your total price for the services and/or products selected for purchase will be stated on your online purchase receipt. Terms of payment are within Moon House Massage’s sole discretion and, unless otherwise agreed to by Moon House Massage, payment must be received by Moon House Massage prior to the acceptance of an order.

Prices and service availability are subject to change without notice. We will make every effort to inform our clients of any changes that may occur but encourage all clients to inquire about pricing and available services when booking.

We currently accept Visa, Mastercard, American Express, Discover, and cash. Sorry, no checks. You may opt to leave gratuity via card or cash. Payment is required in full at the time of booking.

C. CLIENT AGREEMENT
It is my choice to receive massage therapy. I am aware of the benefits and risks of massage and give my consent for massage. I understand that there is no implied or stated guarantee of success of effectiveness of individual techniques or series of appointments. I acknowledge that massage therapy is not a substitute for medical care, medical examination or diagnosis. I have stated all medical conditions that I am aware of and will inform my practitioner of any changes in my health status. I understand that the American massage therapy association® has provided this form as a reference and is not held liable for any services provided.

Assignment of Benefits

I am responsible for all charges for all service provided. In the unfortunate event that my insurance company denies payment, or makes a partial payment, I am responsible for any balance due. If you, my massage therapist, have contracted with my insurance company at a discount rate for services, the amount remaining will be waived and I will not be asked to pay the balance.

Release of Medical Records

I authorize the release of medical records or other health care information, including intake forms, chart notes, reports, correspondence, billing statements, and other written information to my attorneys, healthcare providers, and insurance case managers, for the purposes of processing my claims.

(Please inform your practitioner immediately upon signing any exclusive Release of Medical Records with your attorney that may impact the above release statement.)

Contract for Care

I will participate fully as a member of my healthcare team. I agree to participate in my own self-care programs and adhere to the plan we select. I agree to communicate with my practitioner any time I feel my well-being is being compromised. I expect my practitioner to provide safe and effective treatment to the best of his or her skills and knowledge.

Signature of parent or legal guardian required if client if is a minor - please call for more information.

I acknowledge that my therapist has given me an appointment time which will be exclusively reserved for me. Failure to provide 24 hours notice of cancelation may result in my account being charged for the therapist time.

 

D. COVID-19 ASSUMPTION OF RISK 

COVID- 19 WARNING The Novel Coronavirus 2019 (COVID-19) is an extremely  contagious virus that spreads easily from person to person. COVID-19 infections have  been confirmed throughout the United States. Federal and state authorities recommend social distancing as well as wearing face coverings as a means to prevent the spread of the virus. COVID-19 can lead to severe illness, personal injury, permanent disability, and death. Participating in Massage therapy puts you in direct contact with individuals, face to face and skin to skin contact will take place, you cannot keep a 6ft distance between you and the client. This could increase the risk of contracting COVID-19. Moon House Massage is recommending all therapists and clients follow CDC and state guidelines and implementing as many precautions as possible to prevent the spread of Covid-19. Despite these precautions, Moon House Massage in no way warrants or guarantees that Pure Knead Clients, Therapists and/or the Clients or Therapists family members will not be exposed to or contract COVID-19 through massage or contact with Moon House Massage Client’s and/or Therapists through massage therapy. Thus, Moon House Massage strongly discourages Clients or Therapists who are at high risk or who have family members who are at high risk for severe illness from continuing to massage or receive a massage. COVID-19 AGREEMENT

By booking a massage online with Moon House Massage or over the phone with Moon House Massage, I acknowledge the contagious nature of COVID-19 and I voluntarily  assume the risk that I, my children and/or my family may be  exposed to and infected with COVID-19 while participating in massage therapy with Moon House Massage activities and that such exposure or infection may result in illness, personal injury, permanent disability, and/or death. I also understand that the risk of becoming exposed to or infected by COVID-19 may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Moon House Massage employees, family members, Clients, Partners, Hotels, and any other affiliate client or client’s family member of Moon House Massage.

 

I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury resulting from exposure to COVID-19 (including, but not limited to, personal injury, disability, and/or death) to myself, my children and my family. I understand that I am in charge of my own health and choices I make when receiving a massage. I understand it is my responsibility to self health screen, if for any reason I am not feeling well or have Covid-19 symptoms I will contact the office immediately to cancel my appointment. I do understand if I cancel an appointment withing 48 hours, due to illness I will not be able to receive another appointment unless I’ve waited 14 days without symptoms.

By booking this massage online or over the phone, "I hereby release, covenant not to sue, discharge, and hold harmless Moon House Massage LLC and its employees, therapists, agents, partners, clients, family members, and representatives, of and from any claims arising out of my children and/or my family’s exposure to COVID-19,  including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any claims based on the actions, omissions, or negligence of Pure Knead Massage and its employees, therapists, agents, partners, client’s, family members, and representatives, whether a COVID-19  infection occurs before, during, or after participation in a Moon House Massage Appointment. I willingly choose to have this massage and assume risk and accept all responsibility for my own actions.”

E. DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free.

We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable.

You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.

You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

In no case shall Moon House Massage, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility.

Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.
